Georgia Trade Name Publishing Requirements

Georgia law (O.C.G.A. § 10-1-490) requires every “person, firm, or partnership, carrying on in this state any trade or business under any trade name or partnership name or other name” to register the trade name of the business with 30 days from “commencing to do business.” As provided by law, the registration shall be filed with the Clerk of the Superior Court “of the county in which the business is chiefly carried on or, in the case of a domestic corporation using any name other than its corporate name, in the county of its legal domicile.”

Notice of the filing shall be published once a week for two weeks in the newspaper which is the legal organ of that County. No person, firm, or partnership already registered shall be required to re-register except in the event of a change of ownership.

If this legal notice is NOT published then you are NOT in compliance with the State of Georgia Law.

Failure to meet the publishing requirement may cause the corporate veil to be broken and disregarded by the state of Georgia. If a business fails to comply, the business, its members, and those interested in doing such business may not maintain any action, suit, or proceeding in any court of the state until this statute is complied with.

By having us publish your Georgia trade name this can be avoided.

In compliance with the statutes, Georgia Business Name Publishing publishes the announcements with a newspaper in the county where your principal place of business is located in accordance with Georgia Law. Please complete the Georgia Trade Name Publishing form and we will publish your trade name so that you can be in compliance with the State of Georgia Statute.
